Overview and Important Definitions
This website is owned and operated by Quantian. By using the Optick mobile app, web application, or website ("Service"), you acknowledge that you have read and agreed to be bound by the following terms and conditions ("Terms of Service"). These Terms of Service constitute a legally binding contract between Quantian Technologies Private Limited ("Quantian", "we", "us", or "our") and you or the company or legal entity you represent as a user of or subscriber to the Optick platform. We reserve the right to update and change the Terms of Service from time to time without notice. Continued use of the Service after any such changes constitutes your consent to such changes.
1. Billing and Payment
You agree to the pricing and payment terms presented to you at the time you sign up for any of our Services on the Sites as a subscriber. The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months/years of service, downgrades, or unused months with an open account. All advertised fees are exclusive of any taxes, levies, or duties imposed by taxing authorities. All billing transactions are processed in Indian Rupee.
2. Cancellations
Unless otherwise mentioned there are no refunds or credits for partially used subscriptions or for downgraded subscriptions during a billing period. Immediately upon your cancellation, you will no longer have access to your account.
3. Provision of Purchased Services
We will (a) make the Services and content available to you pursuant to this Agreement, (b) provide applicable support for the Services to you at no additional charge, and (c) use commercially reasonable efforts to make the online Services available 24 hours a day, 7 days a week, except for planned downtime or circumstances beyond our reasonable control.
4. Data Privacy and Security
Quantian takes the security and privacy of your data seriously. We implement commercially reasonable security measures to protect your data from unauthorized access. You retain ownership of all data you upload to the Optick platform. We will not sell your data to third parties. Please review our Privacy Policy for complete details on how we handle your information.
5. Acceptable Use
You agree to use the Optick platform only for lawful purposes and in accordance with these Terms. You must not use the Service to violate any applicable laws or regulations, transmit unsolicited communications, upload malicious code, or attempt to gain unauthorized access to any part of the Service or its related systems.
6. Intellectual Property
The Optick platform, including all software, algorithms, designs, text, and graphics, is the intellectual property of Quantian Technologies Pvt. Ltd. and is protected by applicable Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Quantian shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of (or inability to access or use) the Service.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
